Terms of Service

This document is an MVP template. It must be reviewed and adapted by qualified legal counsel before MCP Store launches publicly. It is not legal advice.

1. Overview

MCP Store (“MCP Store,” “we,” “us”) operates a trusted marketplace and proxy gateway for Model Context Protocol (“MCP”) servers. We help developers list and monetize MCP servers and help users discover, subscribe to, and connect to those servers through our gateway. By creating an account or using the service, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the service.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use MCP Store. You are responsible for the activity under your account, for keeping your credentials and API keys secure, and for promptly notifying us of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. We proxy, we do not host third-party code

MCP Store is a directory, trust layer, and gateway. The MCP servers listed on the marketplace are hosted and operated by third-party developers, not by us. When you connect through our gateway, we authenticate your request, check your access and usage, and forward the call to the developer’s registered endpoint. We do not host, execute, or control third-party MCP code, and we do not guarantee the availability, accuracy, safety, or fitness of any third-party MCP server.

4. Acceptable use

You agree not to use MCP Store to:

  • violate any law or the rights of others, or transmit unlawful or infringing content;
  • attempt to bypass authentication, metering, rate limits, quotas, or other access controls of the gateway;
  • probe, scan, or attack our infrastructure, or use the gateway as an open or anonymizing proxy to reach destinations other than registered MCP endpoints;
  • interfere with, overload, or disrupt the service, other users, or developer endpoints; or
  • resell, sublicense, or misrepresent access to the service or to a listed MCP.

We enforce per-user, per-MCP, and per-IP rate limits and quotas, and we may apply a global kill switch to protect the platform and its users.

5. Developer responsibilities

Developers who list an MCP server represent that they own or are authorized to operate the registered endpoint and that their listing’s description, permissions, risk declarations, and pricing are accurate and not misleading. Developers are responsible for the security, lawful operation, and support of their own endpoints, for handling any data their MCP receives, and for complying with applicable laws. We may review, label, suspend, or remove listings that are unsafe, abandoned, fraudulent, or in breach of these Terms.

6. Trust labels and unverified listings

Risk labels, verification status, reviews, and reports are informational signals intended to help you make decisions. An unverified listing is shown as such, and risk information is presented before you install. We do not warrant that any label or signal is complete or error-free; you are responsible for evaluating an MCP before connecting it to your tools.

7. Subscriptions, billing, and refunds

Some MCP listings are paid. Payments and subscriptions are processed by our payment processor, Stripe. By subscribing, you authorize recurring charges to your payment method until you cancel. The database record of your subscription is the authoritative source for access decisions at the gateway. Fees are stated at the point of purchase and may exclude taxes, which you are responsible for. Except where required by law or expressly stated, payments are non-refundable; you may cancel to stop future renewals, and access generally continues through the end of the current billing period. Developer payouts, where offered, are governed by separate developer payout terms.

8. Metering and usage data

We meter calls that pass through the gateway. Usage events we record are metadata only — for example timestamps, the listing involved, response status, and counts. We do not log or store the payloads, prompts, arguments, or responses of your MCP calls, and we do not log secrets. See our Privacy Policy for details.

9. Intellectual property

MCP Store and its marketplace, gateway, and brand are owned by us and our licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the service. Developers retain ownership of their own MCP servers and content and grant us the rights necessary to list, display, and proxy them on the platform.

10. Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Third-party MCP servers are operated by their developers, not by us. We make no warranty regarding any third-party MCP, including its availability, security, accuracy, or the consequences of connecting it to your AI tools. You use third-party MCPs at your own risk.

11. Limitation of liability

To the maximum extent permitted by law, MCP Store and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the service or any third-party MCP. Our total liability for any claim relating to the service will not exceed the greater of the amounts you paid to us in the three months before the event giving rise to the claim, or USD 100.

12. Indemnification

You agree to indemnify and hold harmless MCP Store and its affiliates from claims, losses, and expenses arising out of your use of the service, your content or listings, or your violation of these Terms or applicable law.

13. Suspension and termination

We may suspend or terminate access to the service, in whole or in part, at any time if you breach these Terms, to protect the platform or its users, or as required by law. You may stop using the service and close your account at any time.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Continued use of the service after changes take effect constitutes acceptance.
